ORDER. To preserve the Court's jurisdiction pending final disposition of the 1 Petition, Respondents are enjoined from moving Petitioner to a location outside this District, the Southern District of New York, or the District of New Jersey absent further order of this Court. See, e.g., Loc. 1814, Int'l Longshoremen's Ass'n, AFL-CIO v. N.Y. Shipping Ass'n, Inc., 965 F.2d 1224, 1237 (2d Cir. 1992) ("Once the district court acquires jurisdiction over the subject matter of, and the parties to, the litigation, the All Writs Act [28 U.S.C. § 1651] authorizes a federal court to protect that jurisdiction."); Garcia-Izquierdo v. Gartner, No. 04 Civ. 7377, 2004 WL 2093515, at *2 (S.D.N.Y. Sep. 17, 2004) (observing that, under the All Writs Act, 28 U.S.C. § 1651, a district court "may order that a petitioner's deportation be stayed... when a stay is necessary to preserve the Court's jurisdiction of the case"); Khalil v. Joyce, No. 25 Civ. 1935, 2025 WL 750599, at *1 (S.D.N.Y. Mar. 10, 2025) (barring the government from removing petitioner from the United States until the Court could address his claim); Ozturk v. Hyde, 136 F.4th 382 (2d Cir. 2025) (declining to stay a district court order, issued pursuant to the All Writs Act, which transferred petitioner to the district court's territorial jurisdiction, given district courts' "undeniabl[e]... inherent authority to protect [its] proceedings" (citation modified)); cf. Michael v. I.N.S., 48 F.3d 657, 661-62 (2d Cir. 1995) (holding that the All Writs Act provides a federal court of appeals reviewing a final removal order with a basis to stay removal). The Clerk of the Court is respectfully directed to email a copy of this Order and the Petition to the United States Attorney's Office (USAO) for the Eastern District of New York. ORDER TO SHOW CAUSE and Electronic Service upon the US Attorneys Office. The Court is in receipt of Petitioner's 1 Petition for a Writ of Habeas Corpus and 2 Motion for Temporary Restraining Order. Respondents are respectfully ordered to show cause why the 1 Petition should not be granted and shall file a return to the 1 Petition on or before June 2, 2026 at 10:00 AM. In their submission, Respondents shall affirm that they have provided the Court with all facts material to Petitioner's claims and Respondents' opposition to the 1 Petition, and shall attach as exhibits all records related to those facts. Petitioner has also moved 2 for a temporary restraining order providing, inter alia, for his release from custody pending further proceedings. As an alternative to filing a full return on the 1 Petition by June 2, Respondents may confer with opposing counsel and advise the Court prior to June 2 whether they consent to the issuance of an order providing for Petitioner's temporary release from custody (with or without additional conditions reasonably necessary to ensure Petitioner's return to court and compliance with any final order of removal) pending full briefing and adjudication of the merits of the petition. In the event that Respondents do consent to such temporary relief, the Court will adjourn the existing June 2 deadline for a full return on the 1 Petition, and the parties may jointly propose a briefing schedule on the merits of the 1 Petition for the Court's consideration. ORDER granting 16 Motion for Extension of Time to File Response/Reply; ORDER. The Court is in receipt of Respondent's 14 Response to Order to Show Cause and its attachments, ECF Nos. 14-1 and 15-1. The Court notes that ECF No. 15-1 contains only internal ICE communications and does not appear to contain any communications between Cambodian officials and Respondents regarding Petitioner. Respondents are directed to produce to the Court, on or before June 10, 2026 at 10:00 AM, any communications submitted or received by ICE (or any other U.S. government officials) to or from Cambodian officials regarding Petitioner's removal and travel documents, or, if Respondents assert no such communications exist, a declaration detailing the search efforts undertaken to locate such communications. In accordance with the Court's 12 Order, if Respondents assert that no email communications from Cambodian officials exist, Respondents shall also produce any contemporaneous notes of verbal communications between ICE and Cambodian officials.The parties' 16 Joint Motion for Extension of Time is granted. Respondents' response to the 1 Petition is due on or before June 18, 2026 at 5:00 PM, and Petitioner's reply is due on or before June 23, 2026 at 9:00 AM. On consent, the 12 Temporary Restraining Order is extended to July 2, 2026 at 12:00 AM. The Court also notes that Respondents have invoked the party presentation principle, most recently restated in Margolin v. Nat'l Ass'n of Immigr. Judges, 608 U.S. ---, 2026 WL 1463466 (U.S. May 26, 2026), for the proposition that the issue of whether the revocation of [Petitioner's] OSUP was revoked by the proper official is not properly before the Court. 14 Response at 1. The Court further notes, however, that Petitioner explicitly invoked 8 C.F.R. § 241.4(l) and § 241.13 in the 1 Petition and argued that ICE's failure to follow its own mandatory procedures violated those regulations and deprived [Petitioner] of due process. 1 Petition para. 35. Moreover, the Court notes that it has, to date, granted only emergency relief in the form of a temporary restraining order, but that substantive briefing on the underlying 1 Petition is ongoing. In their full return on the Petition, due June 18, 2026, Respondents shall address, inter alia, whether the provisions of the C.F.R. that govern revocation of Petitioner's OSUP, and that require such revocation to be executed by certain officials, were followed when a Detention and Deportation Officer signed the revocation of the OSUP and whether the revocation otherwise complied with due process.
