TEXT ORDER: This matter comes before the Court on Petitioner's emergency petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 (Petition) (ECF No. 1 ), Respondents' letter response (ECF No. 5 ), Petitioner's reply (ECF No. 6 ). Pursuant to this Court's April 20, 2026 Text Order, entered in Petitioner's prior habeas proceeding (No. 26-2302, ECF No. 4 ), Petitioner was provided with a bond hearing before an immigration judge ("IJ") on April 28, 2026, and the IJ denied release on bond on the grounds that Petitioner failed to show he is not a flight risk (ECF No. 5 -3 at 4). In the present matter, Petitioner challenges the fundamental fairness of this bond hearing. (See ECF No. 1 Paras. 34-41.) In its May 28, 2026 Memorandum and Order, the Court ordered Respondents to electronically file "a full and complete answer to the Petition (ECF No. 1 ), which responds to the factual and legal allegations of the Petition" and "provide[s] the relevant legal analysis and record" together with "certified copies of the administrative record and all other documents relevant to Petitioner's claims." (ECF No. 3 at 4.) Because Respondents have not produced either a transcript or an audio recording of the disputed bond hearing, Respondents have failed to comply with this Court's May 28, 2026 Memorandum and Order. The Court thus GRANTS the Petition (ECF No. 1 ), and ORDERS that, within twenty-four (24) hours of the time of entry of this Text Order, Respondents SHALL RELEASE Petitioner under the same conditions, if any, that existed prior to his detention. Within twenty four (24) hours of Petitioner's release, Respondents shall file a status report confirming the time of Petitioner's release. So Ordered by Judge Georgette Castner on 6/19/2026.
