MINUTE ORDER issued by Courtroom Deputy for Chief Magistrate Judge Carolyn K. Delaney on 5/28/2026: Petitioner (A No. 215 814 912) has filed a 3 Motion for Leave to Proceed In Forma Pauperis. Good cause appearing, that request is GRANTED. Petitioner has also filed a 2 Motion for the Appointment of Counsel. There currently exists no absolute right to appointment of counsel in habeas proceedings. See Nevius v. Sumner, 105 F.3d 453, 460 (9th Cir. 1996). However, 18 U.S.C. § 3006A authorizes the appointment of counsel at any stage of the case "if the interests of justice so require." See Rule 8(c), Fed. R. Governing § 2254 Cases. In the present case, the court does not find that the interests of justice would be served by the appointment of counsel at the present time. Therefore, Petitioner's motion is DENIED. Respondents are GRANTED 14 (fourteen) days to file a response to the pending 1 Petition for Writ of Habeas Corpus. Respondents shall include with the response all exhibits necessary to the determination of the issues raised in the petition.
