MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 7/10/2026.On July 6, 2026, the Court ordered Federal Respondents to show cause why the 13 Amended Petition should not be granted and certify the true cause of Petitioner's detention. See 15 Minute Order (citing 28 U.S.C. § 2243). On July 9, 2026, the deadline for Federal Respondents to file their Return to the 13 Amended Petition, Federal Respondents filed a 16 "Supplemental Notice Regarding Class Membership."Federal Respondents' filing does not comply with the Court's 15 Order. First, it is non-responsive to the claim raised in the 13 Amended Petition. Indeed the 13 Amended Petition does not seek relief pursuant to Jacobo-Ramirez. Instead, the Petition challenges the constitutionality of Petitioner's ongoing detention despite the fact that Federal Respondents were ordered by the immigration court to facilitate his voluntary departure by July 7, 2026. Second, the "Supplemental Notice" fails to CERTIFY the legal basis, if any, for Petitioner's current detention, as required by the habeas statute and this Court's 15 Order.Based on the foregoing, Federal Respondents are HEREBY ORDERED to SHOW CAUSE why the Court should not find they have waived or forfeited any objection to the 13 Amended Petition and order Petitioner's immediate release from custody, as Petitioner requests in his reply. See Reply, ECF No. 18 at 2 ("For the reasons stated in the petition--reasons that the government wholly fails to address--the Court should grant relief. It should order Mr. Reyes's release and set a date certain (e.g., within 30 days) by which Mr. Reyes may lawfully complete his voluntary departure while out of custody.")
