(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner has filed a petition for writ of habeas corpus and ex parte application for a temporary restraining order (TRO), seeking his release from immigration detention. Dkt. No. 2. The Court previously dismissed a similar petition by Petitioner with prejudice. See Salazar-Garza v. Semaia, No. 2:25-cv-05324-SB, Dkt. No. 15 (C.D. Cal. Nov. 11, 2025). Courts are not required to entertain a successive habeas petition where the legality of petitioner's detention has previously been determined in a habeas petition that was denied on the merits. 28 U.S.C. § 2244(a); see also Del Raine v. Adams, 58 F. Appx 762 (9th Cir. 2003) (court properly dismissed habeas petition as successive). Because Petitioner's claims appear to be the same as those raised in his prior petition, the Court orders Petitioner to file by June 5, 2026 a supplemental brief addressing whether his petition is barred as successive. (In Chambers) Order by Judge Stanley Blumenfeld, Jr.: On June 24, 2026, the Court ordered the government to respond to the petition and set a July 16 deadline for Petitioner to file any reply. Dkt.
