ORDER. Petitioner filed an emergency motion for temporary restraining order to prevent his transfer to a different detention facility while this habeas petition remains pending. Dkt. No. 2 . As explained below, the motion is denied. The Court finds that Petitioner has not met the required elements for a TRO. He has not pled any facts to show that he faces a substantial threat of serious harm, that the balance of hardships weighs in his favor, or that the requested TRO will serve any public interest. The Court therefore denies the motion to prevent transfer. This habeas petition remains pending, and the Court will enter a separate show cause order requiring an answer from the respondent and setting a briefing schedule. The Clerk is directed to change the caption to reflect that the Warden of the Eden Detention Center is the only proper respondent. All other named respondents will be terminated from this civil action. U.S. Immigration and Customs Enforcement terminated. The Court retains jurisdiction over this petition despite Petitioner's transfer to a different facility. Petitioner has not met the required elements for a TRO to prevent further transfer during the pendency of his case. The Court therefore denies the motion to prevent transfer.
