ORDER - The immigration judge has now twice terminated petitioner's immigration proceedings. (Doc. 6 at 2.) Respondents assert that petitioner received a bond hearing under 8 U.S.C. § 1226(a) while their appeal of the first termination order was pending, in January 2025. (Doc. 6 at 2-3.) On remand from the Board of Immigration Appeals, the immigration judge again terminated petitioner's immigration proceedings on August 27, 2025. Respondents moved for reconsideration and state that motion was denied, but they appealed the denial and the appeal remains pending. (Doc. 6 at 2.) Petitioner may have requested a custody redetermination hearing at some point during the remand but his petition does not make clear when. (See Doc. 1 at 4-5.) IT IS ORDERED no later than August 31, 2026, respondents must provide supplemental briefing of not more than seven pages regarding whether the second termination of petitioner's immigration proceedings constitutes materially changed circumstances warranting a new bond hearing. No later than September 8, 2026, petitioner shall file a supplemental brief addressing respondents' arguments. IT IS FURTHER ORDERED no later than August 31, 2026, respondents shall file a copy of the immigration judge's bond memorandum from the January 2025 bond hearing referenced in Doc. 6 -7 at 2.
