FINDINGS and RECOMMENDATIONS (Text Only): Petitioner (A No. 220 667 686) has filed a 2 Motion for Leave to Proceed In Forma Pauperis. Good cause appearing, that motion is GRANTED. Petitioner has filed a 3 Motion for the Appointment of Counsel. There currently exists no absolute right to appointment of counsel in habeas proceedings. See Nevius v. Sumner, 105 F.3d 453, 460 (9th Cir. 1996). However, 18 U.S.C. § 3006A authorizes the appointment of counsel at any stage of the case "if the interests of justice so require." See Rule 8(c), Fed. R. Governing § 2254 Cases. In the present case, the court does not find that the interests of justice would be served by the appointment of counsel at the present time. Therefore, Petitioner's motion is DENIED. A review of the court's electronic docket reveals Petitioner has commenced two actions where she challenges ICE arrest and detention; this case and 1:26-cv-3252 DAD CKD P. There is not good cause to proceed on both actions as the same relief is sought. Since this action was filed after 1:26-cv-3252 DAD CKD P, IT IS HEREBY RECOMMENDED that the 1 Petition for Writ of Habeas Corpus filed in this action be DISMISSED. These Findings and Recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within 14 (fourteen) days after being served with these Findings and Recommendations, Petitioner may file written objections with the court. The document should be captioned "Objections to Magistrate Judge's Findings and Recommendations." Any response to the objections shall be filed and served within 14 (fourteen) days after service of the objections. Petitioner is advised that failure to file objections within the specified time may waive the right to appeal the District Court's order. Martinez v.
