This is a text only entry; no document issued. ORDER denying 7 Motion to Enforce Judgment; denying 7 Motion for Order to Show Cause. The Court has attempted to establish a uniform process for addressing the excessive number of motions filed in the immigration habeas cases in this district. That process includes a prompt initial review to determine whether the case appears to require a bond hearing. If it does, the Court issues an order requiring the bond hearing. That same order includes the clear caveat that if the Government makes a good faith argument that mandatory detention is required, then the Court's order requiring a bond shall be stayed until the Court can more fully consider the detention issue. In this case, the Court issued a preliminary order requiring a hearing. The hearing was held before Respondents filed a response maintaining that this case required mandatory detention. Now the Government has filed such a response, and an order was entered by the Magistrate Judge to stay the case until the issue could be decided with finality. Nevertheless, counsel for Petitioner has filed an emergency motion to enforce the court's previous order that preliminarily required a bond hearing. The motion lacks merit. The Court will decide the detention issue in due course. Ordered by US DISTRICT JUDGE CLAY D LAND on June 1, 2026 (CDL) (Entered: 06/01/2026)
