ORDER DIRECTING SUPPLEMENTAL BRIEFING/FILINGS. Pursuant to the Courts discussion with the Parties at the Oral Argument held on June 25, 2026, and its oral Order on the record at that time, the Court hereby directs the Respondent to file on the docket a Supplemental Memorandum, no later than Monday, June 29, 2026, at 12:00 PM EDT, detailing when and how the parole status of the Petitioner was altered, modified, or revoked, and by whom and on what authority. The Respondent should also comment on whether the outcome of the removal proceeding noted in Governments Exhibit 2 impacts the legal authority to detain the Petitioner from this date forward. ORDER GRANTING PETITIONER'S 25 MOTION TO WITHDRAW MOTION, VACATING THE COURT'S PRIOR ORDER ECF 24, AND DIRECTING PARTIES TO FILE SUPPLEMENTAL BRIEFING. The Court hereby grants Petitioner's Motion to Withdraw ECF No. 24 25, which is the Court's Order granting the Petitioner's Motion ECF No. 23 for Leave to File Sur-Reply Brief. The Court will strike the filings at ECF 23 and ECF 26 without prejudice, and treat those attachments as withdrawn. The Court notes that it has not read the proffered Sur-Reply brief, either as the attachment to ECF No. 23 or as the filing at ECF No. 26. The Court also orders the Parties to each file supplemental briefing to the Court by Monday, July 13, 2026, at 5:00 PM EDT, addressing several specific questions as to which the parties appear to be in fundamental disagreement. First, was the "CBP One App" a distinct parole program, or was it simply a mechanism of obtaining parole for individuals who would otherwise be eligible for parole under some other program or statutory provision? Put differently, what was the statutory authorization for the Petitioner obtaining a 2-year period of parole? Second, what are the termination/revocation notice requirements for the specific parole program that Petitioner was paroled under, and was the Government required to provide reasoning or separate notice when revoking parole, or can it simply inform an individual that parole has been terminated? And in either case, exactly who/when/how was Petitioner's parole in this case terminated? Third, the Court directs the Parties to provide a timeline, accompanied by citations to and copies of exhibits if appropriate, of relevant documents sent to the Petitioner, when/how the Government is alleging that notice and proof of revocation of parole occurred as to the Petitioner, and when the arrest/detention now in effect occurred relative to that notice.
