MINUTE ORDER. This Court finds, consistent with,Quiroz, the Petitioner is detained pursuant to 8 U.S.C § 1226(a) and is entitled to a bond redetermination hearing. The Petition therefore is granted. The Court orders that: 1) Respondents shall conduct such hearing within four business days of this Order, by July 9, 2026, and 2) the burden of proof shall be on the government to demonstrate by clear and convincing evidence that continued detention is justified. If Petitioner is not provided a bond determination hearing within this time, the Respondents shall release Petitioner. The Parties shall file a status report within five business days of this Order, by July 10, 2026, apprising the Court on whether the bond hearing was held, the result of such hearing, and/or whether Petitioner was released because of such hearing or in compliance with this Order. ORDER. Petitioner Hassan initially filed his Application for Writ of Habeas Corpus on May 14, 2026 (D. 1 ) 26-cv-02090-TPO. That matter was drawn to United States Magistrate Judge Timothy P. O'Hara and the parties unanimously consented to Judge O'Hara's jurisdiction. On July 2, 2026, Judge O'Hara Ordered that Petitioner be afforded a detention hearing and mandated a clear and convincing burden of proof (D. 10 ). A status report was lodged on July 10, 2026 indicating, among other things, that "Petitioner is currently evaluating his legal options, and may wish to file a Motion to Enforce with this Court" (D. 11 at 2). Petitioner has Counsel in that action which remains open. On August 13, 2026, Petitioner filed a new Petitioner proceeding pro se (D. 1 (26-cv-03699-GPG)). That should not have occurred and most likely was an error caused by Petitioner's pro se status (although he perplexingly has Counsel). Petitioner's current dispute is not a new case but is in reality a motion to enforce an Order in a pending and open action in the District of Colorado (26-cv-02090-TPO). The Parties to this dispute need to have the matter litigated before the Judicial Officer who made the pertinent determinations and in the same action. It is therefore Ordered that the Clerk of Court Shall file the following pleadings from 26-cv-03699-GPG (D. 1 ; D. 7 ) into 26-cv-02090-TPO where the matter Shall be considered a motion to enforce.
