ELECTRONIC ORDER: Petitioner's pro-se motion for the Court to appoint him counsel in this new habeas action challenging his immigration detention under 28 U.S.C. § 2241, Dkt. No. 6, is DENIED without prejudice as premature. This case is pending preliminary judicial screening. See Rules 1(b), 4 of the Rules Governing Section 2254 Cases in the United States District Courts. Additionally, there is no constitutional right to the appointment of counsel in habeas actions, and Petitioner fails to otherwise demonstrate that the interests of justice require the appointment of counsel at this early stage of litigation. No. 1 . He also filed an emergency motion for a temporary restraining order (TRO), seeking to prevent his removal from the United States while his petition remains pending, his transfer to another district without prior notice to the Court, and any retaliatory conduct for filing the petition. ORDER. Petitioner Ruben Cartaya Martinez recently filed an amended habeas petition challenging his prolonged immigration detention. Dkt. No. 19 . He also filed a second motion for temporary restraining order and preliminary injunction, seeking his immediate release from the Diamondback Correctional Facility and an order enjoining his re-detention during the pendency of this case. Dkt. No. 20 . Because the motion improperly requests the same relief sought in his petition, the motion is denied. Petitioner's amended petition remains pending. The Court will determine whether Petitioner is entitled to the relief that he seeks after it reviews Respondent's forthcoming answer and any reply that Petitioner should choose to file. See Dkt. ORDER. The Court has reviewed the parties' pleadings, relevant records, and the applicable governing law. For the reasons stated in Respondent's response, the Court concludes that Petitioner fails to demonstrate that his detention is unlawful and, in turn, fails to demonstrate that he is entitled to any of the relief that he seeks in his petition. Petitioner's petition is therefore denied. Petitioner's motion for the Court to expedite its disposition of his petition is dismissed as moot. Dkt. No. 24 . The Court will enter judgment accordingly.
