TEXT ORDER: Before the Court is Petitioner's letter request for an "urgent status conference" (ECF No. 8), arguing that a conference is necessary to "ensure that Petitioner is able to access the appropriate and necessary medical care" and access counsel. (See ECF No. 8) Respondents filed a response (ECF No. 9) and have provided Petitioner's medical records showing that Petitioner is currently receiving dialysis treatment (ECF No. 10). In Hope v. Warden, 972 F.3d 310, 325 (2020), the Third Circuit Court of Appeals recognized that conditions of confinement claims by immigration detainees are cognizable as habeas claims in extraordinary circumstances. Id. Based on the Court's review of the parties' submissions and Petitioner's medical records, the medical records do not support a finding of extraordinary circumstances at this time. (See ECF No. 10). The Court finds an answer from Respondents is necessary to review of the Petition. The Court has previously ordered Respondents to fill a full and complete answer. (ECF No. 5).
