MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 6/25/2026. In their 12 Response to Petitioner's First Amended Petition, Federal Respondents contend that Petitioner is a member of the certified class in Jacobo Ramirez v. Mullin, No. 25-cv-02136-RFB-MDC, but fail to attach any documents to support that assertion. In its 4 Order, the Court ordered Respondents to file any documents referenced or relied upon in their responsive pleading with that pleading. (Order 3:22-4:1, ECF No. 4). Accordingly, IT IS HEREBY ORDERED that Federal Respondents must file on the docket any documents referenced or relied upon in their 12 Response by July 2, 2026. Under LR IC 6-1 parties must refrain from including or must partially redact, where inclusion is necessary, certain personal-data identifiers from all documents filed with the Court, unless the Court orders otherwise. See LR IC 6-1; see also Fed. R. Civ. P. 5.2(a). Federal Respondents are instructed to file the ordered documents in compliance with the text and spirit of LR IC 6-1 and Federal Rule of Civil Procedure 5.2(a) by redacting birth dates, fingerprints, A-Numbers, passport numbers, and any other personal-data identifiers or sensitive information where applicable. ORDER GRANTING PETITION FOR WRIT OF HABEAS CORPUS IT IS HEREBY ORDERED that Petitioner's First Amended Petition for Writ of Habeas Corpus (ECF No. 9 ), is GRANTED. IT IS FURTHER ORDERED that Respondents must RELEASE Petitioner from detent ion on his personal recognizance on August 14, 2026, between the hours of 12:00 P.M. and 3:00 P.M. Counsel for Petitioner (or their designee/agent) will be permitted to wait in the Federal Justice Tower lobby during the release window. IT IS FURTH ER ORDERED that Respondents are prohibited from imposing release conditions that substantially interfere with Petitioner's liberty, such as location monitoring, without having established the reasonableness of those restrictions, by clear and co nvincing evidence, at a pre-deprivation hearing IT IS FURTHER ORDERED that Respondents must return Petitioner's personal property upon his release. IT IS FURTHER ORDERED that the parties must file a JOINT Status Report by August 15, 2026, to certify compliance with the Court's Order, including the date and time of Petitioner's release. IT IS FURTHER ORDERED that Respondents may not re-detain Petitioner during the pendency of his current removal proceedings until after an immigration court hearing is held, with adequate notice, to determine whether detention is appropriate under the INA and its implementing regulations. To the extent the government seeks to detain Petitioner under 8 U.S.C. § 1226(a), it bears the burden of establishing that detention is appropriate by clear and convincing evidence.
