MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 5/14/2026.The Court is in receipt of Petitioners' unopposed 14 Motion, pursuant to Federal Rule of Civil Procedure 15(a), which seeks leave to add Nevada Southern Detention Center (NSDC) Warden John Mattos as a Respondent in this matter, in his official capacity, as the immediate custodian of Petitioners Suarez, Ibarra-Valdez, Singh, Espinoza, and Morataya. These Petitioners were recently transferred by ICE from Washoe County Jail to NSDC at an unknown date and time. The Court finds the proposed amendment pursuant to Rule 15(a) is appropriate. Therefore, IT IS HEREBY ORDERED the 14 Motion is GRANTED.The 14 Motion references an "attached proposed Second Amended Joint Petition for Writ of Habeas Corpus" but it appears the proposed Amended Petition was inadvertently not attached. However, because the proposed amendment only seeks to add Respondent Mattos as a party, the Court finds no reason to delay this matter and will order a prompt response from Respondent Mattos pursuant to 28 U.S.C. § 2243. The Court will further incorporate Federal Respondents' 13 Return as responsive to the Second Amended Petition.Therefore, IT IS HEREBY ORDERED Petitioners shall file the Second Amended Joint Petition by TODAY 5/14/2026.IT IS FURTHER ORDERED that Respondent John Mattos shall file a return to the Second Amended Joint Petition on or before 5/18/2026.The Clerk of Court is kindly instructed to (1) ADD counsel for Respondent John Mattos to this action and (2) SEND them a copy of this Order through CM/ECF.Counsel for Petitioners shall effectuate service of the Second Amended Joint Petition on Respondent Mattos.(Copies have been distributed pursuant to the NEF - IML) (Entered: 05/14/2026)
