MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 5/14/2026.The Court is in receipt of Petitioners' unopposed 13 Motion, pursuant to Federal Rule of Civil Procedure 15(a), which seeks leave to add Nevada Southern Detention Center (NSDC) Warden John Mattos as a Respondent in this matter, in his official capacity, as the immediate custodian of Petitioners Cruz-Blandon, Varela-Gaucin, Reyes-Esparza, Marroquin-Ruiz, Pantoja-Rodriguez, and Terrero-Vazquez. These Petitioners were recently transferred by ICE from Washoe County Detention Center to NSDC at an unknown date and time. The Court finds the proposed amendment pursuant to Rule 15(a) is appropriate. Therefore, IT IS HEREBY ORDERED the 13 Motion is GRANTED.The 13 Motion references an "attached proposed Second Amended Joint Petition for Writ of Habeas Corpus" but it appears the proposed Amended Petition was inadvertently not attached. However, because the proposed amendment only seeks to add Respondent Mattos as a party, the Court finds no reason to delay this matter and will order a prompt response from Respondent Mattos pursuant to 28 U.S.C. § 2243. Boulware, II on 7/10/2026.The Court has reviewed Petitioners' 22 status report, which confirms Federal Respondents' compliance with this Court's 18 Order. However, with regards to Petitioner Melquiadez, Petitioner's counsel states Respondents did not provide the location of her release in advance, despite repeated requests, and asks the Court to order a supplemental status report explaining why advanced notice was not provided. The Court's 18 Order did not require advanced notice. Further, the parties agreed upon release process for petitioners in Washoe requires advanced notice to counsel only "[w]hen the release is not from 6999 Sierra Center Parkway, Reno, NV[.]" See Joint Proposed Process for the Release of Habeas Petitioners from Immigration Detention, Jacobo-Ramirez v. Mullin, No. 2:25-CV-2136-RFB-MDC, ECF No. 158 (D. Nev. June 12, 2026). Because Ms. Melquiadez's release was at 2:00 p.m. at 6999 Sierra Center Parkway, the Court finds her release complied with the agreed upon process and no further status report is required. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 7/14/2026.In its July 7, 2026 18 Order Granting Joint Petition for Writ of Habeas Corpus, this Court deferred ruling on Petitioner Pantoja-Rodriguez's Petition, because it was unclear from the record whether he filed an appeal of his May 5, 2026 removal order. See ECF No. 18 at 4. Federal Respondents contended he had not, such that his removal order was administratively final, and he was subject to detention under 8 U.S.C. § 1231. Id.. The Court specifically held that if Petitioner had filed an appeal of his removal order, then Petitioner would be a Jacobo-Ramirez Class Member, subject to detention under 8 U.S.C. § 1226(a). See id. (citing Prieto-Romero v. Clark, 534 F.3d 1053, 1060 (9th Cir. 2008)). The Court thus ordered Petitioner to file a status report with the Court certifying whether or not he had filed an appeal.On July 10, 2026, Petitioner filed his 20 Status Report, with supporting documentation, which confirms that Petitioner filed an appeal of his removal order that is currently pending before the Board of Immigration Appeals. Thus, the Court finds Petitioner Pantoja-Rodriguez is a Jacobo-Ramirez Class Member, entitled to the same relief this Court granted to similarly situated Class Members in its 18 Order, for the reasons articulated therein.Therefore, IT IS HEREBY ORDERED that Petitioner Pantoja-Rodriguez's 15 Second Amended Petition for Writ of Habeas Corpus is GRANTED as follows:(1) Respondents must RELEASE Petitioner Pantoja-Rodriguez ON PERSONAL RECOGNIZANCE on July 15, 2026, between the hours of 12:00 and 3:00 p.m. Counsel for Petitioner (or their designee(s)/agent(s)) will be permitted to wait in the Federal Justice Tower lobby during the release window. Petitioner will be provided the opportunity to make a phone call before he is released.(2) Respondents are PROHIBITED from imposing release conditions that substantially interfere with Petitioner Pantoja-Rodriguez's liberty, such as electronic monitoring, without having established the reasonableness of those restrictions, by clear and convincing evidence, at a pre-deprivation hearing.(3) Respondents must RETURN Petitioner's personal property, including any personal identification documents, UPON HIS RELEASE.(4) Respondents are PERMANENTLY ENJOINED from detaining Petitioner under 8 U.S.C. § 1225(b)(2)(A).(5) Respondents may not re-detain Petitioner during the pendency of his current removal proceedings until after an immigration court hearing is held, with adequate notice, to determine whether detention is appropriate under 8 U.S.C. § 1226(a) and its implementing regulations. At this hearing, the government must bear the burden of establishing that detention is appropriate by clear and convincing evidence.(6) The parties must file a JOINT STATUS REPORT by July 16, 2026, confirming Respondents' compliance with this Order including (i) the date and time Petitioner was released; (ii) compliance with this Court's directives concerning release on personal recognizance; and (iii) the return of Petitioner's personal property.The Clerk of Court is kindly instructed to enter judgment accordingly and close this case. The Court retains jurisdiction to enforce its order and judgment. Petitioner may move to reopen this case to enforce the judgment without filing a separate case. The Court also retains jurisdiction to consider Petitioner's request for fees and costs pursuant to 28 U.S.C. § 2412.
