TEXT ORDER - The Court has reviewed the expedited answer and Petitioner's reply. The record reflects that Petitioner was arrested in the interior of the United States at a check-in appointment in May 2025, several months after he was arrested on criminal charges in New York. Those charges were dismissed on March 6, 2026. (ECF No. 1-6.) Based on the record and the Court's prior decisions, the Court holds that Petitioner is unlawfully detained under § 1225(b), in violation of the INA and his Fifth Amendment right to due process. Petitioner has not provided sufficient information about the circumstances surrounding the dismissed criminal charges or the reason for their dismissal. The Court finds that a bond hearing is the appropriate remedy and makes no determination about whether Petitioner is a flight risk or a danger to the community. Given Respondents prolonged detention of Petitioner under the wrong detention statute, the Court will require them to bear the burden of proving by clear and convincing evidence that Petitioner is a danger to the community or a flight risk. It is, therefore, ORDERED that Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge within seven (7) days; at the bond hearing, the Immigration judge shall assess whether Respondents have provided clear and convincing evidence that Petitioner presents a flight risk or a danger to the community; it is further ORDERED that Petitioner's counsel shall have notice of the bond hearing, a reasonable opportunity to prepare, and be permitted to reschedule the hearing outside the seven-day period, if necessary, without seeking this Court's intervention. It is further ORDERED that within three (3) days of that bond hearing, Respondents shall file a written notice of the outcome of that hearing with this Court and request to close this matter.
