TEXT ORDER: The Court having reviewed Petitioner's most recent filing (ECF No. 9 ), which argues that certain decisions of the immigration judge in his underlying removal proceedings may undercut the Government's arguments as to the statute governing Petitioner's detention in this matter, the Government shall e-file a response to Petitioner's correspondence within seven days. Alternatively, to the extent that the Government agrees that Petitioner is now detained solely pursuant to either 8 U.S.C. sec. 1226(a) or the Government's interpretation of 8 U.S.C. sec. 1225(b)(2) and this matter is now not otherwise distinguishable from cases such as Aguilar Ramos v. Soto, No. 25-15315, 2025 WL 3251447 (D.N.J. Nov. 21, 2025), the Government shall provide Petitioner with a bond hearing pursuant to 8 U.S.C. sec. 1226(a) and applicable regulations before an immigration judge within ten days. If the Government determines that the bond hearing route is the optimal route, it shall so inform the Court and Petitioner of the intent to provide him with a bond hearing within three days of this Order.
