ORDER DENYING 8 Motion for Temporary Restraining Order. In the 8 Motion, Petitioner seeks, inter alia, immediate release from detention. ORDER DENYING 18 Second MOTION for Temporary Restraining Order. Petitioner's 18 Second Motion for Temporary Restraining Order appears to be substantively identical to his 8 first motion for TRO. The only difference the Court discerns is Petitioner's inclusion of additional detail regarding Petitioner's arrest on criminal charges and a Pretrial Release Order from the Superior Court of New Jersey, Middlesex County. ORDER DENYING 22 Motion for Reconsideration. On 4/23/2026, the Court issued an 13 order denying Petitioner's 8 motion for a temporary restraining order. ECF No. 13. On 4/27/2026, the Court denied Petitioner's second, substantially similar, 18 motion for a TRO. ECF No. 21. Now, in the 22 Motion, Petitioner asks this Court to reconsider its 21 Order denying Petitioner's second 18 motion for a TRO. Although a court "has the power to revisit prior decisions of its own," it "should be loathe to do so in the absence of extraordinary circumstances." In re Pharmacy Benefit Managers Antitrust Litig., 582 F.3d 432, 439 (3d Cir. 2009) (quoting Christianson v. Colt Indus. Operating Corp., 486 U.S. 800, 816 (1988)). After careful consideration of the 22 Motion, the Court is not persuaded by Petitioner's arguments for reconsideration of the Court's 21 4/27/2026 Order. ORDER GRANTING 27 Motion to Dismiss and DISMISSING 2 Petition for Habeas Corpus. Petitioner, a native and citizen of Nigeria, has been detained at Moshannon Valley Correctional Center since February 2026. ECF No. 2 para. 3. Petitioner and Respondents agree that Petitioner is subject to discretionary detention pursuant to § 1226(a), entitling Petitioner to a bond hearing. That hearing was held on 3/17/2026, after which the immigration judge denied bond based on a finding of flight risk and danger to the community. ECF Nos. 2 paras. 4; 27 at 1. Petitioners appeal of this decision is pending at the BIA. ECF No. 27 at 1. Petitioner asserts that the 3/17/2026 bond hearing violated his due process rights and asked this Court to order his immediate release from custody, or, in the alternative, order a constitutionally adequate bond hearing. ECF No. 2 paras. 17, 19, 62-81. In their 27 Motion to Dismiss, Respondents argue that the Petition should be dismissed because this Court lacks jurisdiction. Federal courts lack jurisdiction to review any discretionary determinations underlying the IJ's bond decision, and may only review whether the bond hearing was fundamentally unfair such that it violates the detainees due process rights. Ghanem v. Warden Essex Cnty. Corr. Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022); see also Quinteros v. Warden Pike Cnty. Corr. Facility, 784 F. App'x 75, 78 (3d Cir. 2019). The United States Court of Appeals for the Third Circuit has advised that a bond hearing under 8 U.S.C. § 1226 is fundamentally fair, and thus satisfies due process, if three essential elements are present: (1) factfinding based on a record produced before the decisionmaker and disclosed to the detainee; (2) the detainee is allowed to make arguments on his or her behalf; and (3) the IJ makes an individualized determination of the detainee's interests. Ghanem, 2022 WL 574624 at *2; see also Quinteros, 784 F. Appx at 78. Accordingly, this Court's review of the bond hearing is limited to considering whether the hearing was fundamentally fair under Ghanem. This Court concludes that the 3/17/2026 bond hearing was fundamentally fair. Petitioner seeks review of the immigration judges bond determination. ECF No. 2 at paras. 5-12. This Court lacks jurisdiction to review the substance of the immigration judges determinations. 8 U.S.C. § 1226(e) (No court may set aside any action or decision by the Attorney General... regarding... the revocation or denial of bond or parole.). Petitioner also asserts violations of his constitutional right to adequate medical care. ECF No. 2 at paras. 77-81. The Third Circuit has repeatedly reaffirmed that ordinary inadequate-medical-care claims are generally not cognizable under § 2241, see Folk v. Warden Schuylkill FCI, 2023 WL 5426740, at *1-2 (3d Cir. Aug. 23, 2023) (per curiam) (holding claims concerning lack of adequate medical care were non-cognizable under § 2241), with a narrow exception in extraordinary circumstances. See Hope v. Warden York County Prison, 972 F.3d 310, 324-25 (3d Cir. 2020) (recognizing limited habeas jurisdiction in extreme cases where release was allegedly the sole adequate remedy during the COVID-19 pandemic). The Court does not minimize the seriousness of Petitioner's allegations. The record reflects that Petitioner suffers several medical issues resulting his living with chronic pain. Nevertheless, the present record does not establish that immediate release is warranted under the extraordinarily narrow standard articulated in Hope. Accordingly, IT IS HEREBY ORDERED that the 27 Motion to Dismiss is GRANTED and the 2 Petition is DISMISSED. Clerk is to mark this case CLOSED. Signed by Judge Christy Criswell Wiegand on 8/3/2026.
