ORDER. It is ORDERED that the 14 Report and Recommendation is ADOPTED. 9 Motion to Dismiss is DENIED. Petitioner Kelvin Edinilson Lopez Mundo's 1 Petition for a Writ of Habeas Corpus is DENIED IN PART, as to the request for immediate rele ase, but GRANTED IN PART, as to the request for a bond hearing. The government is ORDERED to provide the petitioner with a bond hearing in front of an immigration judge pursuant to 8 U.S.C. § 1226(a). The immigration court SHALL provide the peti tioner with the opportunity for a bond hearing prior to any hearing on the merits of his removal, and no later July 27, 2026. The government is ENJOINED from denying bond to the petitioner on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). The government SHALL file a status report with this Court within three days after the petitioner's bond hearing. The government is ENJOINED from rearresting the petitioner, unless he has committed a new violation.
