ORDER. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 8/12/2026.Before the Court is Petitioner's Motion for Leave to File Second Amended Petition (ECF No. 20 ). Through it, Mr. Sanchez Alarcon seeks to file an amended petition based on recent legal developments. See generally Mot. for Leave to File, ECF No. 20 (Aug. 11, 2026). In light of these development, and Petitioner's updated arguments, the Court finds good cause for amendment. See Mayle v. Felix, 545 U.S. 644, 654 (2005) (citations omitted) (clarifying that Federal Rule of Civil Procedure 15 applies to habeas proceedings); see also Fed. R. Civ. P. 15(a)(2) (allowing parties to amend pleadings with leave of court). Therefore, IT IS HEREBY ORDERED Petitioner's Motion for Leave to File Second Amended Petition is GRANTED. The Second Amended Petition (ECF No. 21 ) will serve as the operative petition in this case.With this in mind, the Court has preliminarily reviewed the Second Amended Petition (ECF No. 21 ), as well as Mr. Sanchez Alarcon's Motion for Temporary Restraining Order (ECF No. 25 ), and finds that Petitioner may be entitled to habeas relief under: (i.) Jacobo-Ramirez v. Mullin, --- F. Supp. 3d ---, 2026 WL 879799 (D. Nev. Mar. 30, 2026); (ii.) the Immigration and Nationality Act; and (iii.) the Fifth Amendment of the United States Constitution. To promote the efficient adjudication of this case, the Court CONSOLIDATES briefing for the Second Amended Petition and Mr. Sanchez Alarcon's Motion for Temporary Restraining Order ("TRO"). Respondents are ORDERED TO SHOW CAUSE for Petitioner's detention. See 28 U.S.C. § 2243. Specifically, Respondents must file a "return certifying the true cause of [Petitioner's] detention" by August 17, 2026. Id. Amongst other thing, Respondents' return must: (a.) indicate whether Petitioner is, or is not, a member of the Jacobo-Ramirez Class; (b.) respond to Petitioner's TRO; and (c.) attach any, and all, records which Respondents rely on to justify Petitioner's detention. If Respondents fail to identify a specific authority that authorizes Petitioner's detention, the Court may "fortwith award the writ" Petitioner seeks. See 28 U.S.C. § 2243.IT IS FURTHER ORDERED that, alongside their return, Respondents must file sworn answers to the following interrogatories: (1.) was Petitioner arrested pursuant to a lawfully executed and served administrative warrant under 8 C.F.R. § 236.1(b); (2.) was an initial custody determination conducted as to Petitioner under 8 C.F.R. § 236.1(c)(8); (3.) was a Form I-286, Notice of Custody Determination served to Petitioner under 8 C.F.R. § 236.1(g). Respondents must further attach the following documents to their answers, or certify those documents are not in their possession, custody, or control: (1) Form I-200 Warrant for Arrest of Alien; (2) Form I-286 Notice of Initial Custody Determination.IT IS FURTHER ORDERED Petitioner has up to, and including, August 21, 2026 to reply.IT IS FURTHER ORDERED Petitioner's Motion to Determine Bond (ECF No. 2) is DENIED as duplicative, as it raises similar issues to those presented by his Second Amended Petition for Writ of Habeas Corpus. ORDER GRANTING WRIT OF HABEAS CORPUS. IT IS HEREBY ORDERED Petitioner's Second Amended Petition for Writ of Habeas Corpus (ECF No. 21 ) is GRANTED. IT IS FURTHER ORDERED Respondents must RELEASE Petitioner from detention on his per sonal recognizance on August 29, 2026 between the hours of 12:00 P.M. and 3:00 P.M. Counsel for Petitioner (or their designee/agent) will be permitted to wait in the Federal Justice Tower lobby during the release window. IT IS FURTHER ORDERED Respondents are PROHIBITED from imposing release conditions that substantially interfere with Petitioner's liberty, such as electronic monitoring, without having established the reasonableness of those restrictions, by clear and convincing ev idence, at a pre-deprivation hearing. If Federal Respondents impose release conditions in violation of this Order, the Court will consider contempt sanctions against the agency officials responsible. IT IS FURTHER ORDERED Respondents must retur n Petitioner's personal property, including any personal identification and employment authorization documents, UPON HIS RELEASE. If Federal Respondents fail to do so, the Court will consider contempt sanctions against the agency officials responsible. IT IS FURTHER ORDERED Respondents are PERMANENTLY ENJOINED from detaining Petitioner pursuant to 8 U.S.C. § 1225(b)(2)(A). IT IS FURTHER ORDERED Respondents may not re-detain Petitioner during the pendency of his current remo val proceedings until after an immigration court hearing is held, with adequate notice, to determine whether detention is appropriate under the INA and its implementing regulations. To the extent the government seeks to detain Petitioner under 8 U.S. C. §1226(a), it bears the burden of establishing that detention is appropriate by clear and convincing evidence. IT IS FURTHER ORDERED Petitioner's Motion for a Temporary Restraining Order (ECF No. 25 ) is DENIED AS MOOT. IT IS F URTHER ORDERED the Parties must file a JOINT STATUS REPORT by September 1, 2026 confirming Respondents' compliance with this Order, including: (i) the date and time of Petitioner's release; (ii) compliance with this Court's dir ectives concerning release on personal recognizance; and (iii) the return of Petitioner's personal property.
