MINUTE ORDER (Text Only Entry) signed by District Judge Kirk E. Sherriff on 7/16/2026: The 10 amended motion for temporary restraining order is denied. Petitioner is subject to 8 U.S.C. § 1226(c) due to her 2013 conviction for welfare fraud, but she lived at liberty in the United States for an extended period before being detained at the border pursuant to § 1226(c) on February 9, 2026, when she returned from traveling abroad. See Doc. 9 at ¶ ¶ 46-47; Nielsen v. Preap, 586 U.S. 392, 404-14 (2019) (holding that 8 U.S.C. § 1226(c) applies even if the noncitizen was released from prison and lived at liberty for many years before being detained). Respondents assert, and petitioner does not dispute, that they did not learn of her 2013 conviction until February 9, 2026, when immigration officials encountered petitioner at the border when she was returning to the United States. See Doc. 12 at 1; Doc. 14. Petitioner argues that she has a protected liberty interest based on the time between her release from prison and her recent detention. She argues that the issues in this case are similar to those in Perera v. Jennings, No. 21-cv-04136-BLF, 2021 WL 2400981 (N.D. Cal. June 11, 2021), and Carballo v. Andrews, No. 1:25-cv-00978-KES-EPG, 2025 WL 2381464 (E.D. Cal. Aug. 15, 2025). However, unlike in those cases, immigration authorities learned of petitioner's conviction, and detained her, only when she attempted to re-enter the United States from abroad. Given that she was detained at the border while re-entering the country, petitioner has not shown that she is likely to succeed on her due process claim. Petitioner's motion did not raise a due process challenge based on the length of her detention, and she is not foreclosed from raising such a challenge if her detention becomes prolonged. This matter is referred to the assigned magistrate judge for further proceedings, including the preparation of findings and recommendations on the 9 first amended petition.
