ORDER - On April 17, 2026, petitioner filed a petition for writ of habeas corpus. (Doc. 1 .) That petition contained almost no information, so it was not clear the basis for petitioner's request for relief. The court ordered a response, and respondents argue petitioner has no viable claims for relief. (Doc. 7 .) Counsel recently appeared on petitioner's behalf. (Docs. 14 .) Based on counsel appearing, petitioner must file an amended petition identifying the legal and factual basis for his claims. If no amended petition is filed, the court will summarily deny the petition. IT IS ORDERED no later than June 19, 2026, petitioner shall file an amended petition. Respondents shall respond to the petition within ten days of its filing and petitioner shall file a reply within five days of the response. ORDER - On June 21, 2026, newly-appointed counsel filed an amended petition for habeas corpus in compliance with the court's previous order. (Docs. 20, 23 .) That order had also required a response to the petition within ten days of its filing. (Doc. 16 .) After conferring about discovery-related issues, the parties filed a joint notice that stated "Respondents adhere to the arguments submitted in the response to the pro se petition" and advised Respondents would not be "filing a further response to the amended petition." (Doc. 26 at 2.) The amended petition includes a new claim and provides significant additional details on the claim asserted in the original petition, many of which appear material to resolving the petition. In other words, the court does not consider the previous response as addressing the arguments raised in the amended petition. IT IS THEREFORE ORDERED if Respondents intend to oppose the amended petition, they must file a new response within 10 days of the date the amended petition was filed as the court previously ordered. If Respondents are instead intentionally waiving response to the arguments raised in the amended petition, they must notify the court by July 1, 2026. If Respondents file a substantive response, the reply will be due five days later as previously ordered. If Respondents instead waive response, no reply will be necessary.
