On May 14th, counsel for the petitioner filed an amended habeas petition contending that he is a member of the certified class in Jacobo-Ramirez v. Mullin, Case No. 2:25-cv-02136-RFB-MDC. The government must file a notice by May 21, 2026, indicating what statutory authority it asserts Ramos is detained under and whether it agrees that he meets the criteria for class membership. The government must attach the petitioner's (1) Form I-862 Notice to Appear and (2) Form I-213 Record of Deportable or Inadmissible Alien, as well as any other documents it relies on to support its position. If the government contends that Ramos is not a class member, then it must also file a response to the petition by May 26, 2026. Martinez Ramos's reply will be due on June 2, 2026. MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 6/5/2026. Petitioner Edwin Martinez-Ramos moves to preclude his transfer out of this district. 16 After Martinez-Ramos's counsel filed a first amended petition challenging his pre-removal-order detention, the federal respondents filed a notice stating that Martinez-Ramos received a removal order on May 13, 2026, and that he waived his right to appeal that order. 11 Under 8 C.F.R. § 1241.1(b), a removal order becomes final on the date of the order's issuance if the petitioner waives appeal. So it is the respondents' position that the petition is moot and it is permitted to lawfully deport Martinez-Ramos. 13 ICE officials have informed Martinez-Ramos that he is scheduled to be deported today, June 5, 2026.Martinez-Ramos asks that this court stop his removal, arguing that "the respondents have not provided the audio or transcript of his hearing to show that [his] waiver was voluntary, knowing, and intelligent." 16 at 2. He contends that his 30-day window for appeal is still open and thus that he may not be lawfully deported.I deny Martinez-Ramos's motion. Absent some evidence, like a declaration from Martinez-Ramos stating that he did not voluntarily waive his appellate rights or records showing that he filed an appeal, this court will not assume that the immigration court's record of his waiver is inaccurate. And a noncitizen's decision to waive appeal means that his removal order becomes final on the date that it is issued. 8 C.F.R. § 1241.1(b). On this record, I cannot conclude that Martinez-Ramoss removal would be unlawful.The respondents are reminded of their obligation to file a notice with the court within five days of the petitioner's removal. 3 (Copies have been distributed pursuant to the NEF - MH) (Entered: 06/05/2026)
