ORDER: 1) The Clerk's Office shall send a copy of Claude's petition, its attachments, and this Order to the USAO for the Eastern District of Kentucky via e-mail address. 2) Within 60 days from the entry of this Order, the Respondent shall file a response to Claude's petition. That response shall be in the form of a memorandum addressing the factual allegations and legal claims contained in the petition; neither a formal motion to dismiss nor a motion for summary judgment would be appropriate. The Respondent shall also attach any documentary evidence relevant to his response and address any defenses applicable to the petition. 3) Once the Respondent files a response, Claude may file a reply within 21 days. The Court will then further consider the Petition and enter any appropriate Orders. 4) Claude must promptly inform the Court, in writing, of any change in his mailing address.
