MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on April 20, 2026: Before the Court is Petitioner's Motion for Temporary Restraining Order ("TRO"). (ECF No. 2 .) Respondents filed an opposition. (ECF No. 9.) Although, the Court ordered a reply, Petitioner did not file a reply. The parties agree Petitioner's detention is governed by 8 U.S.C. § 1226(a), requiring a bond hearing. Petitioner alleges that he has been detained for over 3 months without a bond hearing. (ECF Nos. 1, [2.]) Respondents produced two orders from immigration judges reflecting that Petitioner was provided with bond hearings on December 30, 2025 and March 26, 2026. (ECF Nos. 9 -2, 9 -3.) Petitioner did not argue any constitutional or statutory deficiencies as to the bond hearings provided. Therefore, Petitioner has not carried his burden of a likelihood of success on his claims, which are predicated on Respondents' failure to provide a bond hearing. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (articulating the standard for a TRO, including a likelihood of success on the claims); Alliance for the Wild Rockies v. Cottrell, 632 F.3d 1127, 1135 (9th Cir. 2011) (Petitioner must "make a showing on all four prongs" of the Winter test). Accordingly, Petitioner's motion for TRO is DENIED. This matter is REFERRED to the assigned U.S. Magistrate Judge for all further proceedings.
