PAPERLESS ORDER. THIS CAUSE comes before the Court on Petitioner's Motion to Enforce Judgment. ECF No. 15 . Respondents filed a Response in Opposition, and the Court held a hearing on the Motion on July 8, 2026. ECF Nos. 17, 21 . The Court also reviewed the transcript of Petitioner's bond hearing and the Order of the Immigration Judge. ECF Nos. [15-1], [15-2]. Upon careful consideration of the parties' submissions and argument of counsel, the pertinent portions of the record, and the relevant authorities, for the reasons articulated on the record which are incorporated herein, the Court concludes that the bond hearing Petitioner received on June 2, 2026 did not comport with due process or comply with this Court's Order Granting in Part Petition for Writ of Habeas Corpus. Accordingly, it is hereby ORDERED AND ADJUDGED that the Motion to Enforce Judgment is GRANTED IN PART AND DENIED IN PART. Within seven (7) days of the date of this Order, Respondents shall either release Petitioner or afford him an individualized bond hearing where (i) he is given a meaningful opportunity to be heard, (ii) the basis of any oral rulings is sufficiently articulated to make clear the reason(s) why bond is granted or denied, and (iii) the written order is consistent with any oral rulings. As the Court previously ordered, the bond hearing must consider whether Petitioner is a risk of flight or a danger to the community. The pending appeal or Petitioner's immigration status alone cannot be the basis for which a bond is denied. Finally, Respondents shall, within 24 hours of the bond hearing, file a Status Report indicating the outcome of the bond hearing and, if release on bond is denied, the reason(s) for the denial.
