(IN CHAMBERS) ORDER by Judge Andre Birotte Jr.: On March 26, 2026, Petitioner pro se Jorge Luis Castano Gaviria (Petitioner) filed a Petition for a Writ of Habeas Corpus (Petition, Dkt. No. 5 ) challenging his March 9, 2026 re-detention by ICE at a regularly-scheduled check-in, and his continued detention at ICEs Adelanto Processing Center, where he remains in custody. Also on March 26, Petitioner filed an Ex Parte Application for Temporary Restraining Order (TRO Application, Dkt. No. 3 ), seeking his immediate release, among other relief. These documents were docketed on March 30 and 31, 2026. Pursuant to Appendix C to the Local Civil Rules, Agreement on Acceptance of Service, the Petition and Application were sent to the Notice Only email account designated by the U.S. Attorneys Office when they were docketed. This Courts standing orders provide that responses to ex parte and TRO applications must be filed within 48 hours after service. MINUTES (IN CHAMBERS) ORDER GRANTING PETITIONER'S EX PARTE APPLICATION FOR A TEMPORARY RESTRAINING ORDER AND ORDER TO SHOW CAUSE by Judge Andre Birotte Jr.: The Court GRANTS Petitioner Jorge Luis Castano Gaviria's Application for a TRO 1 and ORDERS: (1) Respondents are ORDERED to IMMEDIATELY RELEASE Petitioner from custody, subject only to the conditions of his pre-existing parole. The parties are ORDERED to file a Joint Statement regarding Respondents' compliance with this Order by Monday, 4/6/2026, at 5 PM. (2) Respondents are ENJOINED from re-detaining Petitioner without notice of the reasons for revocation of his parole and a pre-deprivation hearing before a neutral immigration judge to determine whether detention is warranted. At any such hearing, Respondents must bear the burden of establishing that Petitioner poses a risk of flight or danger to the community. (3) Respondents are ORDERED TO SHOW CAUSE in writing why the Court should not issue a preliminary injunction. Respondents must file their response by Thursday, 4/9/2026, at 5:00 PM.
