On review the issues raised in Count 2 the Petition appear to mirror those previously addressed by the Court in many prior cases. See Garcia Mariagua v. Chestnut, No. 1:25-cv-01744-DJC-CSK; Ortega v. Noem, No. 1:25-cv-01663-DJC-CKD; Lopez v. Lyons, No. 2:25-cv-03174-DJC-CKD. Respondents are ORDERED TO SHOW CAUSE on or before March 26, 2026, as to why the Court should not grant a writ of habeas corpus as to Count 2 by filing a return as provided in 28 U.S.C. § 2243. In such a return, Respondents identify any factual or legal issues in this case that render it distinguishable from the Court's prior orders listed above and justify denying the petition, or indicate this matter is not substantively distinguishable. This matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary. The Clerk of the Court shall serve a copy of this Order together with a copy of Petitioner's 1 Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 on the United States Attorney. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Magistrate Judge Sean C. Riordan on 7/7/2026: On June 18, 2026, the Court held a status hearing and ordered Respondents to file an update as to Petitioner's voluntary departure process and bond hearing. ECF No. 27 . On June 24, Respondents filed an update stating--without explanation--that Petitioner had not voluntarily departed as planned on June 18 and that an immigration judge found him to be a flight risk at a subsequent bond hearing on June 24. In the meantime, Petitioner also pursued a motion to enforce in the Middle District of Florida, which that court denied on June 24, in light of the ongoing habeas proceedings in this court. See 2:26-cv-00767, ECF No. 22 (M.D. Fla.). On or before July 14, 2026, the parties shall meet and confer and file a joint statement addressing the following: (1) any information concerning Petitioner's voluntary departure process, and (2) if petitioner believes his detention at this point remains unlawful, despite having received multiple bond hearings and despite the order that he voluntarily depart the United States, a proposed schedule for the filing of an amended habeas petition and briefing on such petition.
