ORDER by Magistrate Judge Susan Prose on May 19, 2026. The Amended Application for Writ of Habeas Corpus (ECF No. 5) is GRANTED in part. Petitioner challenges his re-detention following revocation of supervised release without the written notice and informal interview required by 8 C.F.R. §§ 241.4 and 241.13. Respondents acknowledge that formal process remains pending. See ECF No. 15 at 56; Declaration of Jered Waba (ECF No. 15-1) 27. The Court finds that Petitioner is entitled to the process contemplated by the regulations. See Ekenge v. Baltazar, No. 1:26-cv-00630-SBP, 2026 WL 617341, at *11-18 (D. Colo. Mar. 5, 2026) (granting habeas relief where ICE revoked supervised release without notice or hearing in violation of due process and applicable regulations). Respondents shall complete the required notice and informal interview no later than May 28, 2026. Respondents shall file a status report confirming compliance no later than May 29, 2026. The Court declines to order immediate release at this time. If Respondents fail to provide the required process by the deadline, Petitioner may seek further relief.
