STAY OF REMOVAL AND ORDER TO SHOW CAUSE: The Parties must carefully read the full contents of the attached Order to Show Cause and comply with all directives. As set forth in the attached Order:1. The parties are ORDERED to appear before this Court for a hearing on the Petition on Tuesday, March 24, 2026, at 4:30 p.m. in Courtroom 1040 of the Alfonse D'Amato United States Courthouse, 100 Federal Plaza, Central Islip, New York, 11722;2. MEMORANDUM AND ORDER: For the reasons set forth in the attached Memorandum and Order, the Petition for a Writ of Habeas Corpus is GRANTED IN PART. (ECF No. 1 .). Respondents must coordinate with Petitioner's counsel and thereafter release Peti tioner, without any conditions, including but not limited to the condition of electronic monitoring whether GPS monitoring or any other form, into the physical care of their counsel or another mutually agreed upon person at the earliest possible t ime agreed upon by the parties, but no later than 10:00 am, March 22, 2026. Respondents must release Petitioner with all of his belongings that are in Respondents' possession, including but not limited to all identification ca rds, clothing, and money. Respondents shall confirm compliance with these directives, including by identifying the individual to whom Petitioner was released, in a filing on the docket by 5:00 pm on March 22, 2026. Additionally, pendi ng the issuance of any final removal order against Petitioner, Respondents are enjoined from denying Petitioner bond in any subsequent proceeding on the basis that he must be detained pursuant to 8 U.S.C. § 1225(b), absent a change in relevant c ircumstances consistent with this Order. At this time, the Court reserves ruling on the request for attorneys' fees and costs under the Equal Access to Justice Act set forth in the Petition. Petitioner may file an application for attorne ys fees and costs incurred in pursuing this action by June 19, 2026. The Court holds in abeyance Petitioner's remaining claims, including his request for relief in the form of a restoration of deferred action.The Show Cause hearing sched uled for March 24, 2026, at 4:30 p.m. in the Alfonse DAmato U.S. Courthouse will proceed for argument on the remaining issues in Petition. MINUTE ENTRY: Show Cause hearing held before Judge Nusrat J. Choudhury on March 24, 2026, at 4:30 PM in Courtroom 1040, Alfonse D'Amato U.S. Courthouse. Ian Daniel Eppler appeared for Petitioner. Mary M. Dickman appeared for Respondents. Court reporter ToniAnn Lucatorto was also present. The Court heard argument from the parties regarding the request in the Petition for an order restoring Petitioner's deferred action. Petitioner represented on the record that the Petition sets forth no further requests for relief that remain outstanding. The parties met and conferred and submitted a proposed briefing schedule for Respondents' Motion to Dismiss the Petition's request for restoration of deferred action, which the Court so ordered.
