TEXT ORDER: Petitioner MARCELA QUIROZ-QUIROZ is a citizen of Mexico with no criminal history who allegedly entered the United States without inspection in 2015 and has continuously resided in the United States since that time. (ECF No. 1, Petition at 23, 42.) She was arrested by Immigration and Customs Enforcement ("ICE") on March 20, 2026. (Id. at 22.) She has filed a habeas Petition pursuant to 28 U.S.C. § 2241 challenging her detention by immigration authorities. The Chief Judge entered a Text Order staying her transfer (ECF No. 3), which shall remain in effect while this case is pending. In Mejia v. Cabezas, No. 25-CV-17094, 2025 WL 3294405, at *2 (D.N.J. Nov. 14, 2025), this Court found that a similarly situated noncitizen could only be detained under 8 U.S.C. § 1226(a). It is, therefore, ORDERED that in accordance with 8 U.S.C. § 1226(a), within 7 days of the date of entry of this Text Order, Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether she presents a flight risk or a danger to the community, pursuant to 8 C.F.R. § 236.1(c)(8), (d)(1). It is further ORDERED that Petitioner's counsel shall have notice of the bond hearing, a reasonable opportunity to prepare, and be permitted to reschedule the hearing outside the seven-day period, if necessary, without seeking this Court's intervention. It is further ORDERED that within three (3) days of that bond hearing, Respondents shall file a written notice of the outcome of that hearing with this Court and a request to close this matter. Alternatively, if Respondents contend that this case is factually or legally distinguishable, they shall file an expedited answer within five (5) days of the date of entry of this Text Order, and Petitioner may file a reply within three (3) days thereafter. The Motion for a Preliminary Injunction pending at ECF No. 2 shall be ADMINISTRATIVELY TERMINATED considering the relief provided. So Ordered by Judge Robert Kirsch on 04/24/2026. TEXT ORDER: Currently pending before the Court are Petitioner's Motion to Expedite Proceedings and Motion for Immediate Release. (ECF No. 8 - 9 .) Petitioner has been detained since March 20, 2026; she appears to concede that she has a reinstated order of removal, that she is detained under 8 U.S.C. § 1231(a), and that her detention does not exceed the presumptive six-month period set out in Zadvydas v. Davis, 533 U.S. 678 (2001). She contends, however, that this presumption is rebuttable, and that Respondents have not adjudicated her claim that she has a fear of removal to Mexico or provided her with a meaningful custody review. Petitioner also argues that Respondents have violated their own regulations, which provide that a non-citizen subject to reinstatement of a prior removal order who expresses fear of returning to the country of removal "shall be referred" to an asylum officer for a reasonable-fear determination, and USCIS has exclusive jurisdiction over that determination. The Court directs Respondents to file a written response to the motion and supplement the record within seven (7) days. That response shall address Petitioner's arguments and provide all evidence in their possession regarding Petitioner's credible fear determination, and any custody reviews they have provided to her, which must include the reason(s) for denying release on an order of supervision. Respondents shall also provide all evidence in their possession regarding their efforts to effectuate Petitioner's removal from March 20, 2026, onward. The response must be accompanied by a certification from a deportation officer assigned to Petitioner's case or other official with personal knowledge. Petitioner shall submit a reply brief within 5 days of Respondents' response, and the response must include the ages (not birth dates) of Petitioner's children, which have been redacted from the documents submitted to the Court.
