MINUTE ORDER (Text Only Entry) signed by District Judge Kirk E. Sherriff on 7/13/2026: The 2 motion for temporary restraining order is denied. Petitioner entered the United States without being inspected, admitted, or paroled by an immigration officer in May 2023, and he was released on his own recognizance pending removal proceedings. See Doc. 6-1. Noncitizens who have previously been released into the interior of the United States pending their removal proceedings are subject to 8 U.S.C. § 1226(a). See, e.g., Sharan S. v. Chestnut, No. 1:25-CV-01427-KES-SKO (HC), 2025 WL 3167826, at *4-8 (E.D. Cal. Nov. 12, 2025). But, in January 2026, petitioner crossed the border into Canada, was denied entry by Canadian officials, and then was re-detained by U.S. immigration officials at the U.S.-Canada border. See Doc. 2 at 2; Doc. 6-1. Courts have found that, despite a prior entry, those who are detained at the border upon re-entering are subject to 8 U.S.C. § 1225(b). See, e.g., Misiara Erbite v. Ripa, No. 2:26-CV-558-JES-NPM, 2026 WL 776143, at *1 (M.D. Fla. Mar. 19, 2026) ("But this is not a situation where a noncitizen was detained at the border and then released into the country. Rather, Misiara Erbite was apprehended at the border when he attempted to reenter the United States and immediately taken into custody, which puts him squarely under § 1225."); see also Cong v. Noem, No. 25-CV-3730-GPC-DEB, 2026 WL 76566, at *3 (S.D. Cal. Jan. 9, 2026) (noting that there was no "dispute that Petitioner is detained under § 1225(b)(1)," in case where noncitizen inadvertently crossed the border into Mexico). Petitioner did not raise a prolonged detention claim in his 2 motion for temporary restraining order, but he appears to have raised such a claim in his 12 memorandum of points and authorities in support of his petition for writ of habeas corpus. The 1 petition for writ of habeas corpus is referred to the assigned magistrate judge for the preparation of findings and recommendations, including consideration of petitioner's prolonged detention claim.
