MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi:ORDER SETTING BRIEFING SCHEDULE ON EX PARTE APPLICATION AND ENJOINING RESPONDENTS FROM REMOVING PETITIONER UNTIL THE COURT RESOLVES THE APPLICATION.The application suffers from several procedural defects that counsel against granting preliminary injunctive relief without notice to Respondents.Notwithstanding, the Court exercises its discretion to consider the application on its merits to the extent it seeks a preliminary injunction.The Court orders further development of the application as follows:Petitioner shall serve the United States Attorneys Office for the Central District of California with the petition and other case-opening documents, the application, and this Order forthwith, and file proof of service by Friday, October 31, 2025, at 12:00 p.m.2 Petitioner also shall file and serve by that date and time a proposed form of order setting forth the specific preliminary injunctive relief he seeks. Respondents shall file a response to Petitioners application by Monday,November 3, 2025, at 12:00 p.m. Petitioner may file a reply in support of his application by Tuesday, November 4, 2025, at 12:00 p.m. The Court sets a hearing on the application for Wednesday, November 5, 2025, at 10:00 a.m.In light of the serious questions going to the merits and the likelihood of irreparable harm raised in the petition and application, and in aid of maintaining jurisdiction over this matter, the Court orders that Respondents and all of their officers, agents, servants, employees, attorneys, and persons acting on their behalf in concert or in participation with them are ENJOINED from transporting, removing, or deporting Petitioner out of the territorial jurisdiction of the Central District of California.
