Judge Richard G. Stearns: ELECTRONIC ORDER entered re 9 Response to Petition for Writ of Habeas Corpus - 2241 filed by Kristi Noem, Todd M Lyons, Patricia Hyde. Petitioner Abigail Lima da Silva Nass "entered the United States with proper inspection and was previously admitted as a Non-immigrant under the B1/B2 category of visas." Pet. para. 2. Da Silva Nass represents that she is married to a U.S. citizen, and "has no criminal background." Id. para.s 3-4. Da Silva Nass agreed to ICE's request to move her to a facility in Maine, with jurisdiction over her habeas petition remaining with this court. After a hearing in Immigration Court, Immigration Judge (IJ) Natalie Smith, without opinion, denied petitioner Abigail Lima da Silva Nass's request for release on bond finding that she is "a danger to the community." Dkt #9-1. According to the government's response to the Petition, Da Silve Nass has until November 17, 2025, to file any appeal to the denial to the Board of Immigration Appeals (BIA). The parties shall notify the court within three (3) business days of the BIA issuing a decision on the merits of petitioner's appeal. In the meantime, consistent with the court's 10/10/25 Order (Dkt #4), petitioner shall not be transferred to another district or removed from the United States without leave of this court.
