(Text-Only) ORDER STAYING CASE. Pending before the Court is a petition for fees 13 under the Equal Access to Justice Act. On June 29, 2026, the United States Supreme Court granted certiorari in Montoya Palacios v. Liggins, No. 26-5251 (June 29, 2026), to answer the question whether, under the EAJA, "any civil action" encompasses an action seeking a writ of habeas corpus to challenge civil immigration detention. The Supreme Court's resolution of that question will potentially affect whether this Court can award the relief sought in the pending fee petition. Accordingly, further consideration of the fee petition in this matter is hereby STAYED pending the resolution of Montoya Palacios. Within 14 days of the Supreme Court's decision, counsel for the parties shall meet and confer to discuss its effect on the pending fee petition, if any, and contact the Court to propose the appropriate determination of the fee petition.
