ORDER by Magistrate Judge Susan Prose on April 9, 2026. Having reviewed and considered the briefing already submitted by the parties, the court respectfully finds it necessary to ORDER additional briefing on the following closely related issues: (1) whether the ninety-day removal period provided in 8 U.S.C. § 1231 begins to run immediately at the time an alien's order of removal becomes administratively final whether or not the alien is presently detained; (2) whether the six-month "presumptively reasonable" period for detaining the alien discussed in Zadvydas v. Davis, 533 U.S. 678 (2001), also begins to run at that time; and (3) if either or both of these periods elapsed before the alien was detained, whether the court must nonetheless consider, pursuant to Zadvydas, whether there is no significant likelihood that the alien will be removed in the reasonably foreseeable future, and--as applicable--whether Petitioner is likely to be removed in the reasonably foreseeable future. The parties should also briefly address (4) whether Petitioner has failed to administratively exhaust his claims. Accordingly, by no later than April 16, 2026, the court orders the parties to file supplemental briefing on these issues on the docket in this matter. In doing so, the court directs the parties to address the analyses of these issues provided in, inter alia, Ulysse v. Dep't of Homeland Sec., 291 F. Supp. 2d 1318 (M.D. Fla. 2003); Farez-Espinoza v. Chertoff, 600 F. Supp. 2d 488 (S.D.N.Y. 2009); Diaz-Ortega v. Lund, No. 19-cv-670-P, 2019 WL 6003485, at *8 (W.D. La. Oct. 15, 2019); Cheng Ke Chen v. Holder, 783 F. Supp. 2d 1183, 1192 (N.D. Ala. 2011), and Jiang v. Bondi, No. 25-cv-922-KG-GBW, 2025 WL 3281819, at *2 (D.N.M. Nov. 25, 2025), as well as any other cases the parties deem to be applicable and relevant. The parties need not confer and may file their supplemental briefs separately. Absent exceptional circumstances, no extensions will be granted. Text Only Entry (sbplc6, ) (Entered: 04/09/2026)
