ORDER - It appearing to this Court that the factual circumstances and legal issues presented in this Petition are materially identical to those presented in other recently filed and adjudicated habeas petitions addressing the propriety of mandatory detention pursuant to 8 U.S.C. § 1225(b)(2), it is ORDERED that Respondents SHALL file, by November 21, 2025 at 5:00 p.m., either a Notice indicating that the factual and legal issues presented in this Petition do not differ in any material fashion from those presented in Sarmiento et al. v. Perry et al, 1:25-cv-01644 (AJT) (E.D. Va.), or an explanation as to why material factual or legal differences between Sarmiento and this Petition exist. It is FURTHER ORDERED that if the Respondents file a Notice that there are no material differences between this Petition and Sarmiento, each of the substantive filings in that habeas proceeding will be incorporated into this habeas proceeding, and this Court will issue a ruling without further filings from the parties. ORDER - For the reasons stated in the accompanying Memorandum Opinion, the Court GRANTS IN PART Petitioner Axel Alessandro Campos-Flores' Amended Petition. (ECF No. 11 .) Respondents are ORDERED to provide Mr. Campos-Flores a bond hearing in front of an Immigration Judge pursuant to 8 U.S.C. § 1226(a). The Court ORDERS that the Immigration Court provide Mr. Campos-Flores with the opportunity for a bond hearing prior to any hearing on the merits of his removal, and no later than seven (7) days from the date of entry of this Order. Respondents are ENJOINED from denying bond to Mr. Campos-Flores on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). Respondents are ORDERED to file a status report with this Court within three (3) days after Mr. Campos-Flores bond hearing and prior to any hearing on the merits, stating whether Mr. Campos-Flores has been granted bond, and, if his request for bond was denied, the reason for that denial. In the event Mr. Campos-Flores is released on bond. Respondents are ENJOINED from rearresting Mr. Campos-Flores, unless he has committed a new violation of any federal, state, or local law, or has failed to attend any properly noticed immigration or court hearing or is subject to detention pursuant to a final order of removal. Should Mr. Campos-Flores be released on bond, Respondents are FURTHER ENJOINED from invoking the automatic stay provision at 8 C.F.R. § 1003.19(i)(2). It is SO ORDERED. Signed by District Judge M.
