ORDER. SERVICE AND APPOINTMENT OF COUNSEL ORDER. IT IS HEREBY ORDERED that the 1 IFP application is GRANTED. IT IS FURTHER ORDERED that the 2 Motion for Appointment of Counsel is GRANTED. The Federal Public Defender for the District of Nevada is appointed to represent Petitioner and is directed to file a notice of appearance (or indicate its inability to represent Petitioner) within 7 days of the date of this Order. If the Federal Public Defender is unable to r epresent Petitioner, because of a conflict of interest or for any other reason, alternate counsel will be appointed. ORDER GRANTING PETITION FOR WRIT OF HABEAS CORPUS - ORDERED the Amended Petition for Writ of Habeas Corpus (ECF No. 9 ) is GRANTED. IT IS FURTHER ORDERED that Petitioner must be released from detention no later than April 16, 2026 subje ct to the conditions of his prior order of supervision. Respondents must notify Petitioner's counsel of the date and time of release in advance of Petitioners release. IT IS FURTHER ORDERED that the parties must file a Joint Stat us Report on the docket no later than April 17, 2026, to certify compliance with the Court's Order. IT IS FURTHER ORDERED that Respondents are enjoined from re-detaining Petitioner in the future absent proof of changed circumstances ma king his removal reasonably foreseeable. IT IS FURTHER ORDERED that Respondents are enjoined from removing Petitioner to a third country without providing Petitioner with adequate notice of intent to seek removal to a third country and due process in the form of an opportunity to seek to reopen Petitioners immigration court proceedings to seek fear-based relief from removal. IT IS FURTHER ORDERED that pursuant to Federal Rule of Civil Procedure 25(d), Acting U.S. Attorney Genera l Todd Blanche is substituted for the currently named Pamela Bondi, and Secretary of Homeland Security Markwayne Mullin is substituted or currently named Kristi Noem. The Clerk of Court is kindly directed to update the docket to reflect these s ubstitutions.
