Drozd on 3/24/2026: Pending the issuance of the court's order resolving the pending 14 motion for temporary restraining order, and unless and until the court orders otherwise, the court ORDERS that respondents shall not take any action to remove petitioner from the United States or to move petitioner out of the Eastern District of California. Respondents shall file a written opposition to the pending 14 motion for temporary restraining order by 5:00 PM tomorrow, 3/25/2026. In that opposition, respondents shall specify whether petitioner has been previously detained by immigration authorities and substantively address whether any provision of law or fact in this case would distinguish it from this court's decisions in Quichimbo-Jimenez v. Warden, California City Correctional Center, 2:26-cv-00739-DAD-EFB (HC), 2026 WL 679378 (E.D. Cal. Mar. 10, 2026) or Cardenas v. Chestnut, et al., No. 1:26-cv-02073-DAD-SCR (HC), 2026 WL 785871 (E.D. Cal. Mar. 20, 2026), and other similar cases previously decided by this court, or otherwise indicate that the matter is not substantively distinguishable. Furthermore, respondents are DIRECTED to indicate in their opposition whether they oppose converting the motion for temporary restraining order into a motion for preliminary injunction and whether they oppose the court resolving the merits of the underlying habeas petition. MINUTE ORDER (Text Only Entry) signed by District Judge Dale A. Drozd on 3/26/2026: On 3/23/2026, petitioner filed a motion for temporary restraining order. (Doc. No. 14 .) Petitioner alleges that he was illegally detained by ICE on 12/3/2025. (Doc. No. 1 at 5.) On 3/25/2026, respondent filed an opposition to the pending motion for temporary restraining order. (Doc. No. 16 .) Therein, respondent states that petitioner entered the United States unlawfully, at which time he was detained and released due to lack of bed space, and on 12/3/2025, petitioner was mandatorily detained pursuant to 8 U.S.C. § 1226(c) because he was arrested for grand theft. (Id. at 2.) It is the case that grand theft is a "qualifying theft offense" that "plainly triggers the application of § 1226(c)(1)(E)(ii)." Haryana-Sandhir v. Warden Golden State Annex, No. 1:26-cv-00405-DJC-SCR, 2026 WL 221372, at *2 (E.D. Cal. Jan. 28, 2026). Because petitioner also entered the United States unlawfully, both requirements of § 1226(c) mandatory detention are met here. Further, because, as far as the court is aware, petitioner has not yet been detained for six months, the detention does not qualify as prolonged. Zadvydas v. Davis, 533 U.S. 678, 701 (2001) ("After this 6-month period, once the alien provides good reason to believe that there is no significant likelihood of removal in the reasonably foreseeable future, the Government must respond with evidence sufficient to rebut that showing."). As such, the court finds that, based on the allegations, evidence, and arguments presently before the court, petitioner is not likely to succeed on the merits of the pending petition for writ of habeas corpus. Accordingly, petitioner's motion for temporary restraining order (Doc. No. 14 ) is DENIED. The petition for habeas corpus (Doc. No. 1 ) and motion to appoint counsel (Doc. No. 2 ) are REFERRED to Magistrate Judge Chi Soo Kim for further proceedings. (Deputy Clerk PAB) (Entered: 03/26/2026)
