MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on February 2, 2026: The court has reviewed Petitioner's 1 Petition for Writ of Habeas Corpus and 2 Motion for Temporary Restraining Order. In his Motion, Petitioner alleges that he was detained by U.S. Immigration and Customs Enforcement ("ICE") in December 2025, after he overstayed his Nonimmigrant Visa. (Doc. No. 2 at 1.) Petitioner further alleges that on January 13, 2026, an Immigration Judge denied Petitioner's request for bond, finding that he was a flight risk. (Id. at 2.) Petitioner contends that at that bond hearing, the Immigration Judge "incorrectly plac[ed] the burden on the Petitioner, instead of the Department of Homeland Security," and Petitioner requests that the court order his immediate release, or in the alternative, order an individualized bond hearing with a different Immigration Judge under 8 U.S.C. § 1226(a). (Id. at 2, 15.) The court hereby DENIES Petitioner's 2 Motion for Temporary Restraining Order for two reasons. First, because Petitioner has not previously been detained by ICE and released on bond, he is not entitled to a pre-deprivation bond hearing. See Ngugi v. Lyons, No. 1:25-cv-01783-KES-EPG, 2026 WL 35610 (E.D. Cal. Jan. 6, 2026) (finding that petitioner was not entitled to pre-deprivation hearing where he had not previously been detained by ICE). Petitioner is entitled to a prompt individualized bond hearing, which Petitioner acknowledges he received on January 13, 2026. (Doc. No. 2 at 1.) Second, because Petitioner has not appealed the denial or his request for bond to the Board of Immigration Appeals, his Motion in this court is premature. See Leonardo v. Crawford, 646 F.3d 1157, 1160 (9th Cir. 2011) (affirming denial of immigration habeas petition, because petitioner "should have exhausted administrative remedies by appealing to the [Board of Immigration Appeals] before asking the federal court to review the [immigration judge's] decision." While Petitioner now challenges whether the Government submitted sufficient evidence to the Immigration Judge for the Immigration Judge to deny Petitioner's request for release on bond, Petitioner has not provided a recording or transcript of the hearing, nor the Government's argument and evidence supporting denial of bond. The Board of Immigration Appeals is better equipped to determine the sufficiency of the evidence on the full record. This matter is REFERRED to the assigned Magistrate Judge for further proceedings. MINUTE ORDER signed by District Judge Dena M. Coggins on 3/31/2026: On 3/20/2026, Petitioner filed a 10 renewed motion for a temporary restraining order based on allegations of deliberate indifference to his serious medical needs and substantial burdens on Petitioner's sincerely held religious beliefs. However, such challenges to the conditions of confinement are not cognizable in habeas actions under 28 U.S.C. § 2241. See Pinson v. Carvajal, 69 F.4th 1072 (9th Cir. 2023); see also Arauco Mendoza v. Chestnut et al., 1:26-cv-00627-KES-SAB, Doc. No. 9 (Feb. 5, 2026) (denying motion for a temporary restraining other where the petitioner sought "immediate release based on her assertion that she has received constitutionally-deficient medical care while in civil immigration detention"). Petitioner has therefore not met his burden of showing that he is likely to succeed on the merits of his habeas claims, as is required for a temporary restraining order. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7 (2008). Accordingly, Petitioner's 10 renewed motion for a temporary restraining order is DENIED. This matter is referred to the assigned magistrate judge for further proceedings. (Text Only Entry) (Deputy Clerk JRW) (Entered: 03/31/2026)

MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Allison Claire on 08/14/2026. Petitioner has filed a motion to supplement and amend the petition, seeking to abandon his original due process claims pertaining to the bond hearing he received, supplement the petition with facts that arose after the filing of his original petition, and present new procedural and substantive due process claims that challenge his prolonged detention without adequate appellate procedures. ECF No. 15 . Based on the court's 16 order, respondents filed a response, arguing the petitioner must wait for ruling by the BIA before seeking relief in this court. ECF No. 17 . The reply points out that the response does not respond to petitioner's concern that his bond appeal has been pending for an extended period of time with no end in sight, despite full briefing and a request to expedite, nor does it address whether Rodriguez Diaz v. Garland, 53 F.4d 1189, 1206 (9th Cir. 2022) forecloses petitioner's prolonged detention claim. See ECF Nos. 17, 18 . Petitioner's motion 15 is properly construed as a motion to amend and supplement under Federal Rule of Civil Procedure 15 and is GRANTED. See Johnson v. Mammoth Recreations, Inc., 975 F.2d 604, 607 (9th Cir. 1992) ("leave to amend should be granted unless amendment would cause prejudice to the opposing party, is sought in bad faith, is futile, or creates undue delay") (citation omitted); Fed. R. Civ. P. 15(d) (a court may "permit a party to serve a supplemental pleading setting out any transaction, occurrence, or event that happened after the date of the pleading to be supplemented"); Keith v. Volpe, 858 F.2d 467, 473 (9th Cir. 1988) ("The clear weight of authority . . . permits the bringing of new claims in a supplemental complaint to promote the economical and speedy disposition of the controversy."). Within 7 days from the date of this order, petitioner shall file the "[Proposed] First Supplemental and Amended Petition for Writ of Habeas Corpus" [15-1] as a "First Amended Petition for Writ of Habeas Corpus." Respondents are directed to file a response to the amended petition within 7 days from the date the amended petition is filed and served. See 28 U.S.C. § 2243. If respondents dispute any factual representations in the amended petition, the response shall include any and all documents necessary to support their view of the facts, including available data and statistics regarding the BIA appellate process and adjudication timelines. Petitioner's reply, if any, is due within 7 days of being served a copy of the respondents' response. Respondents' motion to dismiss 8 the original petition is rendered moot by the amended petition and is therefore vacated. (Text Only Entry). (Deputy Clerk JAA) Modified on 8/14/2026 (JAA). MINUTE ORDER issued by Relief Courtroom Deputy for District Judge Dena M. Coggins on 10/2/2026: On 8/19/2026, Petitioner filed a 20 First Amended Petition for Writ of Habeas Corpus in which he contends that his continued immigration detention predicated on a bond hearing where the immigration judge "improperly placed the burden of proof on Petitioner rather than the Government" has grown unconstitutionally prolonged. Indeed, in Oliveira Tinoco v. Albarran, No. 1:26-cv-05505-DC-CKD, 2026 WL 2949219 (E.D. Cal. Oct. 1, 2026), this court recently found that where a noncitizen is detained based on overstaying their visa and the government has knowledge of the noncitizen's presence in the United States, that noncitizen is entitled to a pre-deprivation bond hearing before they may be detained, unless exigent circumstances exist. The court further found that immediate release is the proper remedy because a post-deprivation bond hearing does not remedy the government's failure to provide a pre-deprivation bond hearing. Oliveira Tinoco, 2026 WL 2949219 at *7. Accordingly, by 12:00 PM on 10/6/2026, both parties shall file a supplemental brief addressing whether this court should order Petitioner's immediate release pursuant to its order in Oliveira Tinoco. Additionally, in their supplemental brief, Respondents shall address whether they intend to deliver Petitioner to his mandatory biometrics appointment at the USCIS Sacramento Application Support Center on 10/9/2026 as discussed in Petitioner's 24 Motion for Temporary Restraining Order and subsequent 29 Status Report, in the event Petitioner has not already been released by this court pursuant to Oliveira Tinoco. ORDER signed by District Judge Dena M. Coggins on 10/06/26 GRANTING 20 First Amended Petition for Writ of Habeas Corpus as follows: Petitioner Jagandeep Singh (A-216-068-272) shall be RELEASED IMMEDIATELY from Respondents' custody with the same conditions he was subject to immediately prior to his detention in 12/2025. Respondents SHALL NOT impose any additional restriction on him, such as electronic monitoring, unless that is determined to be necessary at a future pre-deprivation/custody hearing. Respondents shall RETURN all of Petitioner's documents and possessions (e.g., identification, passport, work permit, Social Security card, etc.) upon his release from custody. By no later than 10/08/26, Respondents shall FILE a notice of compliance with this court confirming that Petitioner has been released in accordance with the above; If the government seeks to re-detain Petitioner, it must provide no less than 7 days' notice to Petitioner and must hold a pre-deprivation bond hearing before a neutral arbiter, at which Petitioner's eligibility for bond must be considered; and This order does not address the circumstances in which Respondents may detain Petitioner in the event Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal. 24 Motion for TRO is DENIED as MOOT as Petitioner will no longer be in Respondents' custody at the time of the biometrics appointment; 21 22 Motions are DENIED as Moot by this Order. The Clerk is directed to serve a copy of this order on the California City Detention Facility and to enter judgment for Petitioner. CASE CLOSED. (cc Cal City) (Deputy Clerk KML) (Entered: 10/07/2026)
