Text Order GRANTING 10 Motion to Lift Stay entered by Judge Xavier Rodriguez. Before the related case, No. SA-26-cv-753-XR (the "'753 Case"), was transferred to the Undersigned for consolidation, Judge Jason K. Pulliam entered a stay of removal. See '753 Case, ECF No. 2. Petitioner is subject to a final order of removal. Immigration officials have been taking steps to effectuate Petitioner's removal to Sudan and report that there is a significant likelihood of removal in the reasonably foreseeable future. However, ICE cannot lawfully execute Petitioner's removal order while the Court's judicial stay is in place. Because federal courts generally lack jurisdiction over "claims connected directly and immediately with a 'decision or action by the Attorney General to commence proceedings, adjudicate cases, or execute removal orders,'" the stay of removal in the 753 Case is LIFTED. Humphries v. Various Fed. USINS Emps., 164 F.3d 936, 943 (5th Cir. 1999) (quoting 8 U.S.C. § 1252(g)). Federal Respondents may effectuate and/or facilitate Petitioner's removal in the ordinary course of business. (This is a text-only entry generated by the court.
