Oliver, GRANTING Petitioner's Motion to Resubmit All of Petitioner's Application ("Motion to Resubmit"). 7 On January 16, 2026, Petitioner filed a Petition for a Writ of Habeas Corpus. 1 Included in the Petition were materials unrelated to Petitioner. On January 28, 2026, Petitioner filed his Motion to Resubmit because Petitioner's case was filed together with another person's case. 7 Petitioner attached to his motion a Petition for Writ of Habeas Corpus related only to his claims. On February 5, 2026, the Clerk of the Court docketed a corrected petition -- the First Amended Petition for Writ of Habeas Corpus -- removing portions of the originally-filed Petition unrelated to Petitioner. 8 Accordingly, the Court GRANTS the Motion to Resubmit. ORDER by Magistrate Judge Rozella A. Oliver: denying 28 EX PARTE APPLICATION for Temporary Restraining Order ("TRO") as to immediate release; finding as moot 30 SECOND EX PARTE APPLICATION to Expedite (for order shortening time on briefing schedule). The Court denies Petitioner's Application for TRO. A TRO may be issued upon a showing of immediate and irreparable injury, loss, or damage to the movant before the adverse party can be heard in opposition. Fed. R. Civ. P. 65(b)(1). A party seeking a TRO must demonstrate, inter alia, that they are likely to succeed on the merits. Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 22 (2008). The Court finds that Petitioner has not adequately demonstrated that he is entitled to the relief he seeks and denies the Application for TRO. The Court denies as moot Petitioner's application to shorten the time on the briefing schedule. Briefing has been completed, and the Court takes the matter under submission. The Court denies Petitioner's Third EX PARTE APPLICATION for TRO. A TRO may be issued upon a showing of immediate and irreparable injury, loss, or damage to the movant before the adverse party can be heard in opposition. Fed. R. Civ. P. 65(b)(1). A party seeking a TRO must demonstrate, inter alia, that they are likely to succeed on the merits. Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 22 (2008). The Court finds that Petitioner has not adequately demonstrated that he is entitled to the relief he seeks and thus denies the Third EX PARTE APPLICATION for TRO. 37 .
