(Text Only) ORDER TO SHOW CAUSE: Petitioner filed a document entitled Amended Petition 13 in which Petitioner requests release, or in the alternative, a new bond hearing with the benefit of counsel. The Court construes this document as a motion to amend the Court's previous Order requiring Respondents to conduct a bond hearing 6 and the Court's previous Order 10 granting in part Petitioner's Motion to Show Cause 9 . On or before February 10, at 11:00 a.m. CT, Respondents are ordered to file a response to the Petitioner's request for release, or in the alternative a new bond hearing with the benefit of counsel. The response should include a reasoned memorandum of law and fact as well as any supporting documentation that may be needed to establish the lawfulness of Petitioner's warrantless arrest and a response concerning whether conducting the bond hearing without providing Petitioner access to counsel should result in a new bond hearing. No reply will be permitted, and the Court will decide the motion without a hearing and based on the written submissions. Further, Respondents are temporarily restrained and enjoined from moving the Petitioner out of the District of Minnesota until the Court has issued a ruling on the pending Petition. If Petitioner has already been removed from Minnesota, Respondents are ordered to immediately return Petitioner to Minnesota as soon as possible and in any event no later than February 10, 2026. MEMORANDUM AND OPINION: The Motion to Amend (Doc. No. 13 ) is GRANTED in part and DENIED in part, and that the Court's previous Order (Doc. No. 6 ) is amended. Respondents are ORDERED to release Petitioner from custody immediately in Minnesota without conditions, and in any event no later than 4:00 p.m. CST on February 12, 2026. On or before 11:00 a.m. CT on February 13, 2026, counsel for Respondents shall file a letter affirming that Petitioner was released from custody in Minnesota without conditions in accordance with this Order.
