NOTICE OF DEFICIENCY AND ORDER. The Clerk is directed to change the caption of this case to reflect that the only proper petitioner is Jose Leonardo Morillo Gonzalez, who is proceeding pro se. Osorio will be removed as a party to the case. However, the case cannot proceed without any suggestion of interest from Gonzalez. As a result, if Petitioner Gonzalez wishes to pursue these habeas claims, he must file an amended petition and either pay the $5.00 filing fee or file an application to proceed in forma pauperis within 30 days. Additionally, because Osorio lack standing to seek relief on behalf of Gonzalez, the Court denies the emergency motion for immediate release and the motion for expedited review without prejudice to Gonzalez's right to seek relief in his own name. Dkt. Nos. 4, 5 . The Clerk is directed to mail a copy of this order to Osorio. But she will not receive any further notice of the proceedings here. The Clerk is also directed to mail Petitioner Gonzalez a copy of the original petition filed here, Dkt. No. 1, an application to proceed in forma pauperis, a certificate of inmate trust account, and a blank Section 2241 form marked, "amended" and stamped with this cause number. The Clerk is directed to change the caption to reflect that the Warden of the Bluebonnet Detention Center is the only proper respondent. ORDER. The Court dismissed this case on March 31, 2026 for want of prosecution after Petitioner failed to timely comply with the Court's orders to pay the filing fee and submit a signed, amended complaint. Dkt. Nos. 8, 9 . Now, nearly two months later, Petitioner filed his signed, amended petition and paid the $5 filing fee. Dkt. No. 10 . He also filed motions for expedited review and temporary restraining order. Dkt. Nos. 11, 12 . Because Petitioner has now cured the filing deficiencies, the Court vacates its order and judgment of dismissal, Dkt. Nos. 9, 10, and directs the Clerk to reopen this case on the docket of the Court.
