ORDER. The Petition 1 is GRANTED in part and DENIED in part and the Motion for TRO (ECF No. 13) is DENIED. The R&R of the Magistrate Judge (ECF No. 16) is APPROVED in part and REJECTED in part, as described herein. The Court ORDERS that Respondents SHALL provide Petitioner with a bond hearing before an Immigration Judge within seven (7) days of this Order. In the event that Mr. Georgii is released on bond by an ImmigrationJudge, Respondents is ENJOINED from rearresting Mr. Georgii, unless (1) he has committed a new violation of any federal, state, or local law, (2) he has failed to attend any properly noticed immigration or court hearing, (3) he is subject detention pursuant to a final order of removal, or (4) the order granting bond is vacated or revoked on a ground other than that Mr. Georgi is detained under 8 U.S.C. § 1225(b)(2). If the Government does not provide such a bond hearing within the time specified, the Government is DIRECTED to release Petitioner immediately under appropriate conditions of release. Respondents SHALL file a status update on the status of Petitioner's bond hearing within three (3) days of the bond hearing.
