Liberally construed, the second amended petition raises a claim that petitioner's prolonged immigration detention without a bond hearing violates his procedural due process rights under the Fifth Amendment. See Woods v. Carey, 525 F.3d 886, 889-90 (9th Cir. 2008) (standards applicable to pro se litigants); Rodriguez v. Marin, 909 F.3d 252, 256 (9th Cir. 2018) (the Ninth Circuit asserted "grave doubts that any statute that allows for arbitrary prolonged detention without any process is constitutional....").
