ORDER (AGS): The government's opposition to petitioner's additional post-hearing submission (ECF 27 ) is due September 2, 2026. Any opposition should address, among other issues that the government seeks to brief, petitioner's contention that "Ms. Skvortsova wanted to appeal to the BIA, but her attorney committed ineffective assistance of counsel by abandoning the bond appeal without notifying Ms. Skvortsova--an abdication of duty that led to a filed bar complaint." (See ECF 27, at 3.). Per Chambers of the Honorable District Judge Andrew G. Schopler on 08/25/2026.(no document attached) (mef) (Entered: 08/25/2026)

Sep 09, 2026
ORDER (AGS): For the reasons stated at the August 14, 2026 hearing, and because petitioner did not first exhaust her remedies, the Court confirms its tentative ruling. The framework discussed on the record applies with equal force to petitioner's claim that she "wanted to appeal to the BIA, but her attorney committed ineffective assistance of counsel by abandoning the bond appeal without notifying" her. (See ECF 27, at 3); Matter of Morales-Morales, 28 I&N Dec. 714, 717 (BIA 2023) (holding that the BIA "will accept late-filed appeals where a party can establish equitable tolling applies"). Nor did petitioner sufficiently raise any "newly discovered evidence," "clear error," or "intervening change in controlling law" that warrants reconsideration. See School Dist. No. 1J, Multnomah Cnty., Or. v. ACandS, Inc., 5 F.3d 1255, 1263 (9th Cir. 1993). Petitioner's amended motion to enforce (ECF 20 ) and reconsideration motion (ECF 27 ) are denied. Per Chambers of the Honorable District Judge Andrew G. Schopler on 09/09/2026. (no document attached) (mef). (Entered: 09/09/2026)
