MINUTE ORDER signed by Magistrate Judge Dennis M. Cota on 1/28/2026: The Court has granted Petitioner's motion for a temporary restraining order, ECF No. 11 . Given that Respondents have asserted that their opposition to the temporary restraining order (TRO) constitutes "the entirety of the Respondents' opposition to both forms of relief [TRO and preliminary injunction]," ECF No. 5, pg. 2, n.1, and that the standard for issuing a Temporary Restraining Order is "substantially identical" to the standard for issuing a Preliminary Injunction, Stuhlbarg Int'l Sales Co. v. John D. Brush & Co., 240 F.3d 832, 839 n.7 (9th Cir. 2001), the court hereby ISSUES a Preliminary Injunction on the same terms of ECF No. 11 . Respondents are ORDERED TO SHOW CAUSE why the Court should not grant the Petition for Writ of Habeas Corpus and enter judgment in favor of Petitioner. Respondents shall file responsive papers by February 10, 2026. Petitioner may file a reply by February 17, 2026. The parties shall indicate whether they waive a hearing.
